Sr. Deputy Public Guardian

ABOUT THE POSITION:

The current vacancy is within Behavioral Health Services, Public Guardian Program. The Sr. Deputy Public Guardian is a key position providing court investigations and case management services for complex cases involving trusts and properties. This is a lead position with higher responsibilities such as acting as a back-up supervisor, providing training, presentations, creating desk procedures or other resource documents with supervisor approval.

The Office of the Public Guardian is dedicated to the physical and financial safety of persons unable to do so on their own that are conserved when there are no viable alternatives to public conservatorship. The Superior Court determines whether a conservatorship should be established, involving a court process that includes petitioning the court and notifying the proposed conservatee and his or her family of the proceedings. A conservatorship is only established as a last resort through a formal hearing. The Court can appoint the Public Guardian as a conservator of the person only, estate only (for probate) of both person and estate.

MAJOR DUTIES AND RESPONSIBILITIES:

  • Conducting Lanterman-Petris-Short (LPS) and probate case investigations and administration
  • Consulting with County Counsel to interpret sections of State and Federal regulations, Welfare and Institution and Probate Codes pertaining to Public Guardian program matters
  • Developing, reviewing, and monitoring multiple, complex cases/projects and ensuring compliance with State and Federal regulations, Welfare and Institutions and Probate Codes, confidentiality laws, program policy, and funding source requirements
  • Making presentations to Adult Protective Services (APS), external business partners, care providers, and other outside groups to explain Public Guardian programs
  • Providing guidance, training and assistance to lower deputy staff in complex, sensitive, and difficult cases
  • Attend court as Public Guardian representative/court officer or testifying on matters related to conservatee or litigation related to estates and other legal matters
  • Marshalling assets when necessary
  • Providing case Administration of complex Trusts and conservatorships
  • Managing estate real and personal property including completing all required actions in property management and sales.
  • Assessing cases and utilizing the most appropriate community and welfare resources to provide effective conservatorship services
  • Acting as lead Deputy in a unit and serving as acting supervisor in the absence of the regular supervisor

THE IDEAL CANDIDATE:

The ideal candidate will possess a Bachelor's Degree or higher from an accredited college in Social Sciences, Behavioral Sciences, Business Administration, Accounting, or a related field, and will have two years of demonstrated experience as a Deputy Public Guardian II and at least five (5) years of experience providing court investigations for cases involving trusts, investment assets and managing real property. The ideal candidate will also have the ability to interpret and apply the Omnibus Clause, Prudent Rule, Financial Industry Regulatory Authority and the Uniform Investor Act which includes the Certificate of Authority and the duties and powers associated with trusts. He/she will also have the ability to maintain appropriate education and professional certification as a Deputy Public Guardian or Conservator as required by California State Association of Public Administrators, Public Guardians, and Public Conservators. A California Real Estate Brokers License is desirable.

In addition, the ideal candidate will demonstrate knowledge and experience in the following competencies:

Technical Expertise (Public Guardian/Conservatorship)

  • Understanding and applying Health Insurance Portability and Accountability Act (HIPAA) and Personal Health Information (PHI) laws and regulations
  • Preparing reports, written correspondence, and/or investigations to internal and external audiences
  • Reviewing trusts documents, making decisions to invest or liquidate per the terms of the trusts and estate needs
  • Interviewing multiple partners to gain knowledge and background information to advocate for the well-being of the client and ensuring services, including medical, psychiatric, and placement
  • Working with a variety of adult clients, including those with physical, mental or developmental disabilities
  • Acting as a liaison on behalf of clients and appearing in court when needed
  • Understanding and applying basic Welfare and Institution and Probate Codes for California
  • Handling estate and finances of conservatee, including paying bills, closing financial accounts, establishing or administering trusts, and accommodating needs of the client
  • Understanding and applying business arithmetic and legal terminology

Sound Judgment/Analysis and Problem Solving

  • Reviewing and analyzing reports to be presented to the court, identifying problems, developing resolutions, and making recommendations
  • Reviewing and assessing pertinent and complex case information/developments and conservatee needs to determine and pursue an appropriate course of action in compliance with departmental policy and governing regulations/laws
  • Managing and monitoring a caseload and taking timely and effective actions to meet deadlines, court demands and conservatee personal and estate needs despite competing priorities
  • Reporting suspicious behavior and circumstances as a mandated reporter

Leadership Skills

  • Providing training to lower deputy staff on investigations, court report writing, general case management, and other related subjects
  • Serving as a key participant in meetings and trainings
  • Making presentations to staff and leading group discussions
  • Providing directions to staff and performing duties as a back-up supervisor

Communication Skills

  • Documenting information in charts and files and preparing court reports
  • Providing timely, accurate, and concise informational updates to the Court Officer on cases appearing on the Probate or LPS court calendar
  • Writing timely, comprehensive, and accurate reports to remain in compliance with County, State and Federal guidelines

  • Collaborating with family members and medical providers on behalf of the client
